1. Agreement to Terms
These Terms of Service and Sale (“Terms”) govern your access to and use of the Thesis50 website and the purchase of our digital study guides (“Breakdowns”). By accessing our platform or purchasing a product, you agree to be bound by these Terms, which are governed by the laws of Victoria, Australia.
2. Terms of Sale & Refund Policy.
Thesis50 provides premium digital study guides, annotated essays, and structural frameworks (each a “Breakdown”). All purchases represent one-time payments for permanent licensing access under these Terms. Pricing is in Australian Dollars (AUD) and includes Goods and Services Tax (GST) where applicable.
2.1 Risk-Free 14-Day Satisfaction Guarantee.
We offer a voluntary, satisfaction-based guarantee for first-time purchases. You are eligible to claim a refund for any Breakdown within exactly 14 calendar days (336 hours) from the precise timestamp of your purchase transaction, subject to the anti-abuse provisions in Section 2.5.
2.2 Manual Email Intake Process.
To prevent automated scraping and license exploitation, Thesis50 does not feature automated instant-refund buttons. Refund requests under our 14-day satisfaction guarantee must be submitted manually by emailing customer support at support@thesis50.com. Your request must be sent from your registered account email address and include your purchase transaction receipt, the exact Breakdown slug/title, and a brief description of why the material did not meet your expectations.
2.3 Australian Consumer Law (ACL) Statutory Guarantees.
Our digital goods come with statutory guarantees that cannot be excluded, restricted, or modified under Schedule 2 of the Competition and Consumer Act 2010 (Cth) (the Australian Consumer Law). For major failures with our digital goods, you are entitled to a replacement or a full refund. A major failure includes circumstances where the Breakdown:
- Is substantially unfit for its disclosed purpose and cannot be easily remedied;
- Is unsafe or inaccessible due to severe and persistent technical failures (e.g. permanent server-side file corruption or database delivery failures); or
- Differs significantly from its advertised description, study design, or set text material.
If the problem is not major, we will remedy the issue (such as correcting errata or restoring server access) within a reasonable timeframe. If we fail to do so, you are entitled to a refund.
2.4 Change of Mind Limitations.
Subject to your non-excludable statutory rights under the ACL, change-of-mind refund requests made past the 14-day satisfaction guarantee window are strictly excluded. Due to the immediate delivery nature of digital files and intellectual property, all sales are considered final after the 14-day guarantee period has expired.
2.5 Anti-Abuse, Fraud, and Fair Use Rules.
To protect our student authors' copyrighted materials, the 14-Day Satisfaction Guarantee is strictly subject to fair-use guidelines. Thesis50 reserves the right to deny refund claims if we identify behavior that exploits our system. Triggers that void guarantee eligibility include, but are not limited to:
- Systematic downloading, scraping, local saving, or copying of a substantial portion of the guide content during the guarantee window;
- Account sharing or transferring credentials, as detected by concurrent device signatures and geographical location access thresholds (refer to Section 4);
- Serial or pattern-based purchasing and refunding across multiple texts or accounts; or
- Submitting false or fraudulent claims to bypass licensing restrictions.
Denial of a voluntary guarantee refund under Section 2.5 does not affect your non-excludable statutory consumer rights under the Australian Consumer Law.
3. User License & Intellectual Property
When you purchase a Breakdown, Thesis50 grants you a non-exclusive, non-transferable, revocable license to access the content solely for your personal, non-commercial educational use.
All study guides, annotated essays, templates, and content are the intellectual property of Thesis50 and our student authors. You are strictly prohibited from copying, distributing, republishing, reselling, or sharing any portion of our guides with third parties without our express written consent.
4. Account Sharing & Fair Use Restrictions
Your account and access privileges are strictly personal. Account sharing is explicitly prohibited.
To protect our authors' intellectual property, the platform employs automated metrics and device-based detection thresholds. If the system detects simultaneous access from multiple distinct locations or devices exceeding our fair use security rules, your account may be temporarily or permanently suspended without refund, subject to our statutory consumer guarantee obligations under the ACL.
5. Educational Outcomes Disclaimer
Thesis50 provides high-scoring analysis and strategies to help students prepare for VCE English exams. However, we do not guarantee any specific study scores or academic outcomes. Academic results depend on many factors, including the student's individual effort, school-assessed coursework (SACs), and external exam performance.
